M.B., while it is unusual that non-owners have the ability to serve on the Board let alone President, it is not unheard of. Is the association still under control of the developer or has control been moved to the Board? If it is the developer, there may not be any requirements for service on the Board. If the association is controlled by the unit owners, then the governing documents will hold the answer. They very likely detail the eligibility requirements for people to serve on the Board. If the governing documents dictate that only unit owners can serve on the Board, then a non-owner has no business being on the Board or serving as President.
