Dear Mister Condo,
Can an Association hold a Notice & Hearing Meeting via conference call with all parties? Thank you.
Mister Condo replies:
V.M., I don’t see why not, at least, in theory. It would really depend on the legality of virtual meetings and communications as agreed upon by the association. The true difficulty comes in the storage of the meeting as it would be an official record of the association. Minutes would still need to be taken and the meeting would have to be discoverable in the event of any contested actions as a result of the meeting, just like any other meeting of the association. The upside is efficiency; the downside is record storage (and expense). That being said, I know of many associations that you conference calling and other modern conveniences to hold their meetings. Unless your association has rules against such meetings, it is very likely possible. All the best!
