Dear Mister Condo,
Our condo by-laws were created in 1979. It states meetings should be held every 2nd Tuesday of June. This schedule was never followed in the past. Meetings have been held at convenience as needed. The new condo laws I read do not specify dates. Whom shall we follow?
Mister Condo replies:
D.S., it is not uncommon for a condo association’s by-laws to stipulate a schedule for meetings such as yours does. However, with proper notice, there is no reason that an association could not change their meeting date to better suit the needs of the unit owners, which is what has been done in the past from what you have told me. Since I don’t know exactly which state you are from, I cannot comment on new condo laws for your state. However, I am not aware of any state condo laws that do specify dates for annual meetings for condominium associations so it is most likely up to the association to select the date that works best for association members and then provide proper legal notice to all unit owners of the meeting. LOL – Our docs said “First Monday in April”, which conflicted with NCAA basketball finals! When UCONN teams started winning in the 1990’s, we simply moved it to Wednesdays or we would have never had any BOD members attend! LOL
