M.K., unless the fire pit is in conflict with local, state, or federal regulations and as long as it doesn’t violate any governance rules of the association, I don’t see why not. My concern (any maybe yours, too) is liability to the association for operating the gas fire pit. What is someone gets burned or hurt? Is the association liable? You bet! The bigger question is are they insured properly and indemnified from any injury claims. Fire pits can be fun and enjoyable amenities but the risks have to be considered. My guess is that your Board looked at the risks and benefits and decided the benefits were worth the risk. All the best!
If is a material change to the common elements, the Unit Owners would need to vote on that (at least here in Florida)
