Dear Mister Condo,
We have parking rules at our complex. No parking in front of garages. No parking in red zones. No parking in same spot more than 24 hours. Parking placards must be displayed from 8pm to 5am. The board wants to enforce everything except the parking placards rule. They say they don’t have money to buy the placards in the budget. Is this type of enforcing legal due to not enforcing all rules?

V.N., in my opinion, the Board’s decision is valid and does not violate any enforcement rules. My bigger concern is why they don’t have money to buy the placards. Placards are not very expensive and should be included in the Annual Budget so that there is always money available. However, my guess is that this Board is trying to keep the monthly fees as low as possible and have made the decision that increasing the common fees to pay for the placards isn’t worth the expense to the association. That being said, if unauthorized overnight parking becomes a problem for the association, the Board may have no choice but to increase fees so as to pay for the placards and enforce the parking placards rule. The good news is that it is an easy fix should the parking problem rear its ugly head. All the best!
