Can a condo association use a flag program provided on common grounds by an outside service to meet the guidelines of the rights to fly American flag? This service has a fee charged to each co-owner that chooses to participate.

B.L., since I am not an attorney, I cannot offer a legal opinion on this matter. I will say that the Michigan Condo Act is very clear that the association “shall not prohibit a co-owner from displaying a single United States flag of a size not greater than 3 feet by 5 feet anywhere on the exterior of the co-owner’s condominium unit”. Regardless of whether or not an alternative flag display program is offered and/or available, I don’t see the association prevailing if they were taken to court for prohibiting a display of the American flag. Here in Florida, mine flies proudly! God Bless America!
