Dear Mister Condo,
I live in a Condominium and own a 30’ deeded boat slip. What exactly do I own with this deeded dock space, ie,. The surface of the water to land bottom? How far out from the Seawall?
Mister Condo replies:
P.L., I am not an attorney so please don’t take my reply as legal advice. If you need a legal interpretation of what you own, you should seek the counsel of a locally qualified attorney. That being said, what you likely own is the right to use the dock space and that’s it. The State of Florida has defined Riparian Rights and you can read all about it here: https://www.flsenate.gov/Laws/Statutes/2011/253.141. I am guessing the waterway in question is ultimately owned by the State of Florida and available to the public. If so, your deeded use of the boat slip is just that. Hope that helps. Happy Boating!
