Dear Mister Condo,
My condo had a roof leak. CC & R’s state HOA is responsible. I contacted my insurance company and they took care of it. I had to pay my $500.00 deductible. HOA said it was my responsibility. Not sure why. Any ideas?

C.A., I am sorry that you experienced a roof leak that caused you damage. This is quite common. Your insurance is used for damage inside your unit. Since you have a deductible of $500, that portion of the repair is your responsibility. You can challenge the HOA’s denial of reimbursement for your deductible but that is not a common practice and would likely cost you more than the $500 deductible. Deductibles are an important part of insurance and should be reviewed when you purchase your insurance. If the $500 is too extreme an amount for you to cover out of pocket, you might want to look at a policy with a lower or no deductible. Typically, those policies cost more in annual premium so most folks are satisfied paying the lower premium and understanding that they will be out of pocket for the deductible should they have to make a claim, as you have recently done. This is BS! If you live on the roof top of an old house and have had water intrusion, State Law In Ct. states a mold remediator and a mold test must be performed…Then It must go to local health departments and at the state level if it is toxic. Yale New Haven environmental department called me, as I had 7 mold toxins. The State of CT. is imposing a law for 2023 calling for mold to be part of inspection..And I am fighting for it…Mold can Kill you, and it’s time to stop it.
