Dear Mister Condo,
If an outside AC unit is damaged by a lightning strike is the Association liable for the repairs?
Mister Condo replies:
B.H., I am sorry your air conditioner took a lightning strike. I have to say that is a little too common in Florida, isn’t it? I also live in Central Florida, the lightning strike capital of the world! Unfortunately, I am not aware of any provision in condo or HOA governing documents that would hold the association liable for either the damage or the repair. That may be covered under your homeowner’s insurance policy. If not, the God of Lightning has dealt you a blow that you will have to repair on your own. All the best!
