D.J., I am not an attorney so I cannot offer any legal advice here. However, I will say that I am not aware of any law that would prohibit an association from hiring whoever they wanted to work for the association, provided they follow the proper procedure. From an ethical perspective, the appearance of impropriety would make me question the integrity of the individuals involved. Certainly, there are plenty of people other than the brother of one of the association’s officers who could hold this job. Even though there may be no wrongdoing whatsoever, there is an appearance of possible wrongdoing that is easily avoided by the Board member stepping down or by not hiring a relative to do the job. That being said, as long as the hire was made in accordance with how the association would hire any other employee, there is likely nothing illegal about it. All the best!
