The gutters on the second-floor downspouts just go down a little bit and then the water runs across the flat roof shooting over the gutters on the first floor in the winter time. We have huge icicles. They refused to fix it. I have been asking them to fix it for two years now.

G.B., I am sorry that the design of your gutter and roofing system creates giant icicles. Icicles can be beautiful but very dangerous and even deadly if they break and fall onto an unsuspecting person below. Have you brought the matter to the Board’s attention? It may be costly to reengineer the gutters and downspouts but the long-term effect would be a safer environment for all unit owners and less liability for the association should these icicles actually hurt someone. Asking them to fix it may not be enough motivation for them to act. People are getting injured and, in extreme cases, killed by falling icicles. I don’t care how good your association insurance policy is, if death or injury results in neglect the cost of defending a death or injury lawsuit will far outweigh the cost of prevention.
