Who is responsible for getting the initial water damage inspection done if a unit has a water damage leak on their ceiling? The owner or the upstairs condo?

T.K., I am sorry that you are experiencing a water damage problem. I don’t have a stock answer for you so please accept my answer in the spirit it is given, friendly. I assume you have insurance to help remedy the expense of this damage. Your insurer may insist you get a damage inspection before they make payment to you. In this case, you (or your insurer) may order the damage inspection. Your upstairs neighbor may also have damage and his/her insurer may require a damage inspection report. Finally, when there is damage between neighboring units, it is also possible that the association has had some common area damage. If they are making a claim, the association insurer may require a damage report. I would ask all of the players involved – your neighbor, your association, and your insurer if a damage inspection report is required and who should initiate it. I hope that helps.
