Dear Mister Condo,
We have a no-pet policy for renters. A potential renter wants to move in with his service dog. We are being told that legally we can’t refuse to rent to him. Can you please advise? Thank you
Mister Condo replies:
R.K., services dogs are not considered pets so your condo’s “no pet” policy won’t apply. From a legal perspective, be sure your condo consults with an attorney before making a costly mistake and denying any resident from housing their service dog in your association. Also, tread very lightly on demanding proof of need or certification of the service dog. There are steps you can take to require how the service dog is handled within the community but you certainly cannot deny this potential renter solely on the fact that they have a service dog. Good luck!
