A.C., while it may follow that the HOA is responsible, I hardly think you would win that argument. Accidents such as falling branches are exactly the type of hazard you carry car insurance to cover. You can try to collect from the HOA but my guess is that either they or their lawyer will tell you they are not responsible. You can contact your own attorney to see if a lawsuit is merited but I would suggest you make a claim with your automobile insurer and see if you can’t get the damage repaired that way. All the best!
