Dear Mister Condo,
Resident has motorcycle w/handicap tag. Condo has designated area for motorcycles. Resident
parks where ever he wants; times in ADA space, times in regular space, says tag allows him to.
What can condo do about this?
Mister Condo replies:
T.M., a handicap tag may offer the owner some additional rights when it comes to parking so tread lightly here. I am not an attorney and I would recommend speaking with your association’s attorney before taking any corrective actions here. If your association has rules about parking and regularly enforces the rules, you may be able to request that the owner use either the motorcycle parking area or the designated handicap areas for parking his motorcycle. I am not sure why he would want to park in a car parking space other than it may give him more room for mounting and dismounting his motorcycle. Depending on his handicap, he may require the space. Unless the association is looking for a legal fight, I think I would allow him to park where he sees fit. All the best!
