I was given architectural approval for installation of a mini split heat/air system with some restrictions. When the installation started, the company had to come out of the outside wall at a different area or it would not work. If the HOA is not happy with this can they make me remove it and repair the hole?

R.D., in a word, “Yes”! I am afraid that HOAs have very broad powers in terms of Architectural Compliance. The HVAC system you were approved for could not be installed as approved so another plan was selected. That plan was not approved by the HOA and, therefore, may be unacceptable to the HOA who has the power to enforce the Architectural Control guidelines of the HOA. That means they could require you to remove and repair your home to what it looked like before the unapproved installation. They are called guidelines for a reason. They help the HOA maintain the look and feel of the association at the discretion of the association. I hope it works out for you.
