Is it possible for an HOA to change a common area close to residential units, designated as a “Tranquility Area” containing a quiet sign, plants and benches; to something else? Possibly, something that would generate noise and large gatherings (i.e. fire pit, Cornhole, bocce, horseshoes, pickle ball) diminishing the value of the units overlooking the area?

B.B., common areas are under the control of the association as overseen by the Board of Directors, the democratically elected leaders who are charged with the decisions that govern the association and the use of the common areas. As long as proper procedures are followed, it is quite possible for any common area to be used for however the association sees fit. In your example, I would imagine that the conversion of this space from a “Tranquility Area” to something else would be highly undesirable for you. However, if there is enough demand for a more active “Sports Area” for the space and the Board wants to reallocate the space, they should have the agency to do so. That doesn’t mean you and others can’t request the space be left as is, citing your thoughts on diminishing value, etc.. At the end of the day, it is very likely going to come down to what the Board decides to do. All the best!
