Dear Mister Condo,
If my condo gets damaged because association didn’t fix a roof leak from wind damage and was notified of shingles missing who pays for fixing the inside my insurance or associations insurance?
Mister Condo replies:
S.H., I am sorry that your home was damaged from a roof leak. From what you have side, it sounds like it was a preventable loss had the roof been properly fixed after wind damage from a storm. Regardless of the cause of the damage, your insurance is typically used to cover damage inside your home. Your insurer may seek restitution from your association for the negligence but that is for them to determine. There are times it is just simpler and more efficient for them to pay your claim rather than pay your claim and then sue the association’s insurance as well. This is what homeowner’s insurance is for. It covers the interior of your home when damage occurs. I hope you recover what was lost. All the best!
