Dear Mister Condo,
Can an under 55-year-old purchase a condo in a 55 Senior community for a mother?
Mister Condo replies:
M.K., typically anyone of any age can purchase a condo in any community. However, residency can be limited to a stated age group as per the governing documents. As long as the resident, your mother, is of the appropriate age group, purchasing the condo shouldn’t be a problem for you. In Florida, there are enforceable rules that allow condos and HOAs to prohibit residency by folks that do not meet the age requirements of the association. However, purchasing within the association is another story and preventing you from making the purchase may be illegal. I do not offer legal advice in this column so you may wish to speak with an attorney if you feel your rights have been violated. All the best!
