Dear Mister Condo,
Is board responsible to contact unit owner about noise coming from upstairs unit?
Mister Condo replies:
M.H., the Board is responsible for ensuring that you have peaceable enjoyment of your unit, which should be outlined in your governing documents. However, if a neighbor is the one making the noise, the Board may or may not get involved for a number of reasons. Neighbor versus neighbor is typically a “lose/lose” battle for the Board. The Board can enforce the noise regulations of the association but that can be very challenging. Hopefully, a warning let from the Board will suffice. If not, you can expect a long battle trying to get your peace and quiet back. If the noise is coming from a building component that is under the Board’s control, that is another story. That could be a simple repair to help restore your peaceable enjoyment. All then best!
