How can you file a complaint against a board that is out of control in South Dakota?

T.B., I am sorry that you have a Board that is out of control. I am not aware of any state-wide governing body that oversees the day to day running of condominium associations. In fact, most of the common interest laws in your state are business related. Specific Condo laws are found in Chapter 43-15A of South Dakota Codified Laws but I don’t think you’ll find anything in there about complaining about your Board. So, what can you do? Review your condominium’s governance documents. Here you will find procedures for recalling your Board which is no simple undertaking. For most associations, the correct remedy is to vote the Board members out of office at the next election. Of course, that means having willing and electable replacements ready to run and serve. Otherwise, the folks on the Board tend to stay on the Board and nothing much changes. Perhaps you are ready to serve? Raise your hand and gather support. It’s the best way to get your Board back under control. All the best!
