Dear Mister Condo,
I have an issue with my neighbor about share the driveway. Our house is Condominium, but we only have two units. A few days ago, my neighbor build a fence between two houses, then we have a hard time to drive although the front yard is big but we have a small driveway, like the triangle. I have a question: do we have a law to solve this problem if they don’t break the fence? I had talk to them before but not work.
Mister Condo replies:
G.P., small condominiums such as yours can be quite challenging when unit owners disagree. What’s worse is that when one unit owner takes it upon himself to make changes to the property without agreement from the other unit owner, problems, such as yours arise. Unless your municipality has some type of law or ordinance about fencing, my guess is that there is little you can do about this, especially after the fact. You may wish to consult with an attorney to see if you can sue the other unit owner in your condo to force him to remove the fence but that will create an unpleasant living experience for you in your home seeing as it is just the two of you in the house. If the situation becomes unbearable, I am afraid you will have to either live with it or consider selling your unit and living elsewhere. Good luck!
